Terms of Service

These Terms of Service ("Terms") govern your use of Try The Menu (the "Service"), operated by Tryco Services Private Limited ("Tryco," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Try The Menu is

Try The Menu is a software platform used by restaurants and food outlets ("Restaurants") to publish digital menus, take dine-in and takeaway orders, run their kitchen, and issue bills. Diners use the Service to browse a Restaurant's menu, place orders at that Restaurant, and settle their bill.

Tryco is a technology provider. Tryco does not prepare, sell, or deliver food. Every order is a contract between the diner and the Restaurant. The Restaurant is solely responsible for its menu, prices, availability, food quality, hygiene, allergen and nutrition information, taxes shown on its bills, and for fulfilling each order.

2. Orders

Placing an order through the Service submits it to the Restaurant. An order is accepted when the Restaurant confirms and begins preparing it. Prices, taxes and any charges shown are set by the Restaurant. A Restaurant may decline or cancel an order — for example when an item is unavailable — and will tell you if it does.

3. Payments

You may pay the Restaurant directly (cash or card at the outlet) or, where the Restaurant has enabled it, online through the Service.

Where you pay online, your payment is collected by the Restaurant through the Restaurant's own payment-gateway account and settles directly to the Restaurant's own bank account. The Restaurant is the merchant of record for that payment. Tryco does not receive, hold, pool, or settle your payment, and Tryco is not a party to it. Payments are processed by a Reserve Bank of India–authorised payment aggregator, subject to that provider's own terms.

Your bill is issued by the Restaurant. Any tax charged on it, and any tax registration shown on it, belongs to the Restaurant.

4. Cancellations and refunds

Cancellations and refunds are governed by our Cancellation and Refund Policy, which forms part of these Terms. Because the Restaurant collects the payment, any refund is issued by the Restaurant.

5. Your account

Some features require you to verify a phone number or sign in. Keep your credentials secure and tell us promptly of any unauthorised use. You are responsible for activity on your account. You must be able to form a binding contract to use the Service.

6. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or to place fraudulent orders;
  • interfere with, disrupt, probe, or attempt to gain unauthorised access to the Service or its infrastructure;
  • copy, scrape, resell, or create derivative works from the Service or its content without our written permission;
  • misrepresent your identity or impersonate any person or entity.

7. Intellectual property

The Service, its software, design, and Tryco branding are owned by Tryco and protected by applicable law. Menu content, images, and trade marks belonging to a Restaurant remain that Restaurant's property.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, and we may perform maintenance, with or without notice.

9. Disclaimers and liability

The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. Tryco is not liable for the acts or omissions of any Restaurant, including food quality, safety, allergens, service, pricing, or fulfilment.

To the fullest extent permitted by law, Tryco shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Indemnity

You agree to indemnify and hold Tryco harmless from claims and expenses arising out of your misuse of the Service or your breach of these Terms or of applicable law.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above will change when we do. Continued use of the Service after an update means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of India. The courts at Darjeeling, West Bengal shall have exclusive jurisdiction, subject to any non-waivable right you may have to bring proceedings elsewhere.
